Terms of Service

Welcome to MySportify. These Terms of Service ("Terms") govern your access to and use of the MySportify platform, including our website at mysportify.com and any related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

MySportify is operated by MySportify, LLC, a Delaware limited liability company ("MySportify," "we," "us," or "our"). If you do not agree to these Terms, you may not use the Platform.

1. About MySportify

MySportify is a marketplace that connects people who want to host sports viewing events ("Hosts") with people who want to attend those events ("Guests"). MySportify is not a party to any agreement between Hosts and Guests. We provide the technology platform that facilitates these connections.

MySportify does not own, operate, manage, or control any events listed on the Platform. We are not responsible for the conduct of Hosts or Guests, the quality or safety of any event, or the accuracy of any listing.

2. Eligibility

To use MySportify, you must be at least 18 years old and capable of forming a binding contract. By creating an account, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. MySportify reserves the right to suspend or terminate accounts that violate these Terms.

4. How MySportify Works

For Guests: You can browse events, communicate with Hosts, and book seats at listed events. When you book, your payment is processed through our secure payment provider (Stripe). Depending on the Host's settings, your booking may be confirmed instantly or may require Host approval within 48 hours.

For Hosts: You can create event listings, set pricing and capacity, and manage bookings through your Host dashboard. To receive payouts, you must connect a Stripe account through our onboarding process. You are responsible for the accuracy of your listings and for providing the experience described.

5. Fees and Payments

The MySportify service fee (15%) is non-refundable under all circumstances, including cancellations, refunds, or disputes.

Service Fee: MySportify charges Guests a service fee of 15% on top of the ticket price for each booking. This fee is clearly displayed before you complete a booking.

Host Payouts: Hosts receive the full ticket price for confirmed bookings. Stripe processing fees are absorbed by the Guest. Payouts are processed through the Host's connected Stripe account.

Payment Authorization: When you book an event that requires Host approval, a hold is placed on your payment method. If the Host approves, the payment is captured. If the Host denies the booking or does not respond within 48 hours, the hold is released and you are not charged.

Currency: All prices are listed in United States Dollars (USD).

6. Cancellations and Refunds

Guest Cancellations: Guests may cancel a booking through their dashboard. Refund eligibility is determined by our Cancellation and Refund Policy. The service fee is never refunded.

Host Cancellations: If a Host cancels an event or denies a booking, any authorized payment hold is released in full.

Refund Processing: Refunds of the ticket price are handled by the Host through their Stripe dashboard. MySportify does not process refunds on behalf of Hosts. MySportify's service fee is non-refundable regardless of the reason for cancellation.

7. Host Responsibilities

By listing an event on MySportify, Hosts agree to:

  • Provide accurate and truthful information in their listings
  • Honor all confirmed bookings unless a valid reason for cancellation exists
  • Comply with all applicable local, state, and federal laws and regulations
  • Maintain a safe environment for Guests
  • Respond to booking requests within 48 hours
  • Not discriminate against Guests based on any protected characteristic

8. Guest Responsibilities

By booking an event, Guests agree to:

  • Arrive at the designated time and location
  • Treat the Host's property and other Guests with respect
  • Follow any house rules or guidelines set by the Host
  • Not engage in illegal, disruptive, or dangerous behavior
  • Present their check-in code or QR code upon arrival

9. Prohibited Activities

You may not use the Platform to:

  • Post false, misleading, or deceptive listings or content
  • Harass, threaten, or intimidate other users
  • Engage in any illegal activity
  • Circumvent the Platform's payment system to avoid fees
  • Create multiple accounts for deceptive purposes
  • Scrape, data-mine, or use automated tools to access the Platform
  • Discriminate against other users

10. Content

You retain ownership of any content you submit to the Platform. By posting content, you grant MySportify a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating the Platform.

11. Reviews

After an event, Guests may leave reviews for Hosts and events. Reviews must be honest, relevant, and based on your actual experience. MySportify reserves the right to remove reviews that violate these Terms.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSPORTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

MYSPORTIFY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF SERVICE FEES YOU HAVE PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

MYSPORTIFY IS NOT LIABLE FOR THE ACTIONS, OMISSIONS, OR CONDUCT OF ANY HOST OR GUEST.

13. Indemnification

You agree to indemnify, defend, and hold harmless MySportify, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or your violation of these Terms.

14. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in the State of Delaware. You agree that any claims will be brought in your individual capacity, not as part of any class or representative proceeding.

15. Modifications

MySportify may modify these Terms at any time. We will notify you of material changes by posting updated Terms and updating the "Last Updated" date. Continued use constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
